In these terms and conditions:
"The Owners' shall mean Graeme
and Rachel Watt of Little Hyde Hall Farmhouse, Hatfield Heath
Road, Sawbridgeworth, Herts CM21 9HX, United Kindom
"The Client' shall mean the
person in whose name the booking is made and shall include
the person or persons upon whose behalf the booking is made.
"The Property" shall mean Chalet
Dahu, at Morillon.
Booking and Deposit
No contract is made between the Owners and the Client and
no booking is valid until the Owners have issued an acknowledgement
letter. The acknowledgement letter will be issued by the
Owners (if they accept the Clients booking), after they have
received a completed and signed booking application form,
together with cleared funds of the appropriate deposit. The
owners have the right to refuse to accept any bookings at
their discretion, refunding any deposit received.
Terms of Payment
The full balance of the holiday price must be received by
the Owners no later than 8 weeks prior to the date of the
commencement of the rental period. The Owners reserve the
right in their absolute discretion to treat the booking as
having been cancelled by the Client if any part of the holiday
price has not been received by the date on which it is due
in accordance with the above. In such an event cancellation
terms will apply.
Cancellation by the Client
All cancellations by the Client must be in writing, signed
by the person who signed the booking form and sent by recorded
delivery. Cancellation applies only from the date of receipt
by the Owners of such notice. If the notice is received more
than 56 days before the commencement of the rental
period, only the 25% deposit is forfeit. If the cancellation
notice is received 56 days or less before the commencement
of the rental period, the following percentage of the total
rental price will be payable as a cancellation charge by
the client:

Between 56 - 43 days 50%

Between 42 - 28 days 60%

Between 27 - 15 days 80%

14 days or less 100%
Cancellation by the Owners
In the unlikely event that the Owners have to cancel your
booking due to conditions beyond their control all monies
paid will be refunded. No additional compensation will be
payable
Damage
Clients will be liable for any damage caused by themselves,
their children or visitors. The security deposit will be
refunded less the costs of any extra cleaning or damage which
may have occurred during the rental period
Insurance
Clients must provide evidence of adequate holiday insurance
at the time of final payment.
Owners Liability
The Owners accept responsibility for ensuring that the standard
of facilities and services offered at the property reach
a reasonable standard. The Owners do not accept liability
for any disappointment that the Client may feel as a result
of unrealistic expectations.
The Owners are only liable for death, bodily injury or illness
arising as a direct result of the negligent acts or omissions
of the Owners or any of their employees, sub contractors,
agents or servants acting in the course of their employment
and on the Owners premises. Liability for any other claim
or loss of any nature whatsoever is hereby expressly excluded
whether or not such liability arises as a result of negligence
on the part of the Owners. For the avoidance of doubt, the
Owners accept no liability in respect of loss occurring as
a result of a failure by the Client to adequately supervise
children at the property and the Owners make no representation
that the property is a safe location at which children can
play unsupervised.
Any claims made pursuant to the above must be notified to
the Owners within three months of the end of the rental period.
The Client must assign to the Owners all rights which it
may have against any third party and must give the Owners
and their insurer's full assistance in claiming against such
party.
Representations
Any photographs and advertising material provided to the
Clients are intended to give an overall impression rather
than provide details of the specific contents of the chalet.
Jurisdiction
This agreement shall be subject to English Law |
